Terms of Use – L'original
User Accounts
Any adult residing in an authorized country may create an account on L'original as either an artist or a buyer.
Information Collected During Registration
- First and last name, email address, country of residence, and telephone number
- Artistic preferences (optional)
- Shipping information
- Payment information
This information is used strictly and exclusively to manage orders and is never transferred to third parties.
User Commitments
Users agree to provide accurate information, behave respectfully on the platform, and refrain from using L'original for illegal or abusive purposes.
Intellectual Property and Images of Artworks
Original and Custom Artworks
The artist retains copyright in the artworks offered for sale. The buyer receives a right of private use (personal display). Any commercial use requires a separate written licence. For artworks posted or sold on the platform, L'original holds the commercial rights to use the image.
Prints are available to order directly online. They are produced on demand and shipped within the standard time frames. When an artwork is sold on the site, L'original may offer prints of its image to customers on its mailing lists to increase the artist's visibility. Accordingly, all rights relating to an artwork sold and published on the L'original site belong to L'original, which may offer prints in exchange for 10% of the profits being paid to the artist.
Liability and Penalties
L'original's Liability
As an intermediary, L'original's liability is limited to the amount of the order, except in cases of gross, intentional, or fraudulent misconduct, in accordance with Quebec law.
Force Majeure
In the event of a strike, war, pandemic, or any other event beyond its control, L'original may suspend its obligations without compensation.
Permitted and Prohibited Content
The following are strictly prohibited:
- Hateful, discriminatory, defamatory, or illegal content
- Artworks that infringe third-party rights
Penalties
Any serious breach of these terms of sale may result in the suspension or deletion of the user's account, or even the commencement of legal proceedings before the court of competent jurisdiction.
Artist Agreement – Commitments and Terms
Obligations and Collaboration
The artist agrees to:
- Meet the production and delivery deadlines for artworks and the expected quality standards for goods sold.
- Communicate professionally
- Display the same prices as on their other sales channels
L'original agrees to:
- Promote the artist through editorial content (blogs and podcasts)
- Provide support in the relationship between the artist and the customer
Term of the Agreement
- Prints and original artworks: L'original agrees to display them on the artist's platform page for a maximum of five years.
- The agreement may be terminated at any time by the artist or L'original upon 30 days' written notice.
Compensation
- 65% for original artworks and commissions
- Payments are made by bank transfer within 30 days of receipt of the artwork or final approval
Modification of an Artwork
Validity of the Terms
If any provision of these general terms of sale and use is declared null, invalid, or unenforceable, in whole or in part, such nullity, invalidity, or unenforceability will not affect the validity or enforceability of the remaining provisions, which will remain in full force and effect and binding on all parties.
